Are the tapes alluded to by President Trump actually surveillance tapes taken from Comey's office?

Notice how he emasculated Comey and the swamp denizens by letting them know in a tweet that the Attorney General got information (surveillance “tapes” from the seizure of Comey’s office) to let Comey and his handlers know that Trump’s DOJ has the goods on them.

It’s rumored that he records every conversation he has and doesn’t tell the other party or parties.
So he had recordings to refer to to make his memos.
 
James Comey is a poisonous snake of the highest order… a deep-water Swamp Denizen who has been highly paid to deliberately provide cover for high-level corruption by the Clintons and Obama. He is has been central to trying to destroy the Trump campaign and then the Trump administration from the start. He is as dirty as they come in DC. He had highest-level cover (the FBI no less) and was deep into an effort to eliminate Trump. Trump had to move hard, fast, and at exactly the right time to cut the head off the snake without getting bitten by the snake or being finished by the other swamp denizens.

In his testimony, Comey vaguely suggested that there may be other reasons for Sessions’ recusal. After Comey met in a classified meeting with the intelligence committee, reports leaked out that Sessions may have had a third meeting with Kislyak last year.
Sessions can also expect to be asked about his role in Comey’s May 9 firing. He will also likely be asked about an exchange he had with Comey in mid-February after the then-FBI chief had a one-on-one Oval Office meeting with Trump.

Trump knows everything I have gone through above about Comey. But he has to move carefully. He has to get his Attorney General and Deputy AG in place, get enough leverage on the Russia narrative, and ideally get rid of Comey in a way that allows him to obtain all the information that Comey has been accumulating (if he is taping Trump he is taping others).

The District of Columbia’s wiretapping law is a “one-party consent” law. DC makes it a crime to record a phone call or conversation unless one party to the conversation consents. See D.C. Code § 23-542. Thus, if you operate in DC, you may record a conversation or phone call if you are a party to the conversation or you get permission from one party to the conversation in advance. That said, if you intend to record conversations involving people located in more than one state, you should play it safe and get the consent of all parties.

So legally Comey could record any conversation between himself and others. Are there special laws/regulations in place for recording conversations with the President though? One would think there would at least be laws governing the public release of such recordings.
Did James Comey’s Document Leaks Violate The FBI Employment Agreement?

Paragraph 2 states that all materials acquired in connection with an employee’s official duties are property of the U.S. government and that such materials must be surrendered to the FBI upon an employee’s separation from the agency. Paragraph 3 states that employees are prohibited from releasing “any information acquired by virtue of my official employment” to “unauthorized individual without prior official written authorization by the FBI.” Paragraph 4 of the agreement requires FBI employees, prior to disclosing or publishing information acquired during their employment, to submit the information to FBI authorities for review to determine whether it is authorized for public release.
So if Comey followed protocol and surrendered all government property, including the memos he produced in his capacity as an FBI employee, it would have been impossible for him to provide the memos to his friend. The fact that he was able to provide hard copies of the memos to both his friend and special counsel Robert Mueller suggests that Comey did not surrender them to authorities as required by the FBI employment agreement.
Page two of the agreement lists the types of information disclosures which are strictly prohibited. Included in the list of information that may not be released without prior written approval by the FBI is “information that relates to any sensitive operational details or the substantive merits of any ongoing or open investigation or case.” While the agreement states that unauthorized disclosure of classified information is a violation of the contract, information does not have to be classified in order to be prohibited from unauthorized disclosure. Comey claims that his memos were unclassified.
