The Supreme Court on Thursday said it would keep the block on President Biden’s $400 billion student loan forgiveness program until it takes up the case in February.
The court’s decision to hear arguments relatively quickly means it is likely to determine whether the widespread loan cancellations are legal by late June.
That’s about two months before the newly extended pause announced last month by the White House on loan repayments is set to expire.
The court in a brief order said it would hear oral arguments in the case. It came after the Biden administration sought to lift an injunction on the program imposed by the Eighth Circuit Court of Appeals.
The move provides a timeline for Biden’s debt relief scheme, which has faced multiple lawsuits and has been panned by critics as unlawful and a tax on Americans who never went to college.
The administration had wanted a court order that would have allowed the program to take effect even as court challenges proceed.
But as a fallback, it suggested the high court hold arguments and decide the issue.
